« Reply #50 on: July 21, 2010, 10:20:41 PM »

I spent most of the day working on my diesel truck ac system in hopes to not end up in the ER but at this point I don't care I just want my truck back.....I will more then likely not be bringing it home but it will be put at my friends shop... heck he is willing to fix it up as I can afford the parts and store it inside for as long as I need..... the truck will be getting moved 10 miles total..... LOL go figure. my buddy Rick is going to check and see if this jerk has done anything to my truck...He tried to yesterday but the city had the street torn up due to a line breakage... either way I am going to pick up my truck even if it's in pieces....I don't care it's mine and I want it back....

OK any legal knowledge as to if I can legally put an ad in the paper lets say the classified section calling him out I'm thinking something like what I wrote a while back..... Shannon C. I want my black 97 dodge Ram Back you obtained it illegally... Can I do this without him being able to come back after me? well something along those lines but after I get my truck back don't want to piss him off so he does anything to my truck.

none of this makes any sense. if it's stolen it's stolen and the cops there have to arrest this guy for several broken laws even if he didn't steal it. it is not a civil matter. the cops were supposed to impound the truck when they found it. something stinks here.

i know your medical situation prevents you from going there in person but depending on oklahoma laws you might be able to get a power of attorney drafted to someone who is able to go there and get it.  having a 1hr consult with a lawyer might not be a bad idea.  i know lawyers are usually evil, but there is a time/place for them, and this may be it.

what many people said here is absolutely correct - stolen or not, you know it's there and every minute you wait about getting it is one less moment he has to wait to LEGALLY take it.  they've told you where it is, you've talked to him about it, and if he makes a case in court that you've not tried to pick it up in person/proxy, the court WILL side on his behalf.  he will make the case that he's offered it back to you (which he hasn't) and it turns out your word vs his.  he has the truck, and he will win.

I was planning on making the run up there this week but I'm not sure I'm going to be up to it..... But only time will see.... from what I have been told I just have to go file for a rit of assistance  thus making it so the cops can help but I have to do it during the week..

O ya on a second note I did call the cops on the guy again... had them go out and check on my truck and all.....I reported it stolen again from the advice of the state trooper....

be careful of the 30 day possession laws. Just go get your truck, get some tags for it, slap them on drive away, bring All your buddies and bats to stand guard and drive it away if it's yours legally.

I do have a issue as to why the cops will do nothing over a blatantly stolen vehicle though... weird. Huh

nothing really to report on the truck....I still have not been able to drive that far... I'm hoping to feel up to it here very soon.... the only thing I have done is called the cops on him again.... I have had the cops at his house twice in two weeks.... he can't claim the truck...I think I'm starting to piss the cops off making them go to his house all the time. I keep calling the truck in stolen.... so if they close it then I call it in again.. they have to go check on it and all... this is what the state trooper told me to do...plus it insures that the guy who has it can't do anything with it... if the truck gets hurt he will be taken to jail for being a chop shop...

I would reinsure it, get a few friends, get it back to running and hit his truck on the way out. Ooops. Was so busy putting the parts you pulled back on I forgot your truck was behind it.

Or maybe get it mobile enough to be a misunderstanding and have it towed out. A little trip to the edge of the road to get pulled out by a tow truck. Wow, power steering pump must have fallen off when it went into the yard, imagine that.

This does not sound comfy to hang out in his yard. I'd get it ASAP anyway possible. Too much done that I'd worry about him stealing little bits with lots invested.

I understand a lack of insurance, but there should be something. His truck is a Dodge w/TF? Know how to get one out of park from outside?

Your power steering pump that off but in the truck could be his that doesn't work anymore.

Scott,
If I was anywhere near you, I would drag it home for you on general principles.  I hate thieves, and douchebags like that.  I would drag his POS wrecked truck out into the street, and take your truck back to you.

My dad went through six months of chemo not that long ago.  Just keep on putting one foot in front of the other, you will get through it.  My dad had stage 4 non-hogkins lymphoma, and has been cancer free for about six months...

Easy, hook it up to another truck and pull. The parking pawl is pretty easy to break. Ive seen it happen just from the weight of a 20' boat on a loading ramp. Its always fun to watch someone panic while their truck rolls into the drink.

Breaking the parking pawl works. Also just unhooking the shift linkage and sliding the lever does to. Do make sure you chock the wheels  before you do this. Well, at least chock them until you are out from under the truck. Dropping driveshafts will work but takes a bit of time. There are several methods.

I am all in favor of just hooking on and dragging it the hell out of the way. Or, pushing it out of the way with another truck is acceptable to.

send an impartial 3rd party pro to do the job. Inform thief that he will be paying for haulers time or he will be doing time. county sherrifs have much bigger balls than local mayberry cops.  okalahoma or not, receiving stolen property is receiving stolen property.    think of it this way.  Wanna buy this Van Goh painting I just stole? Its really ok, I'll give you a receipt, cops cant touch you.

That's too many questions. If I was dumb enough to buy something without a title that ran and drove it's my fault. It someone provided me a title of ownership I would surrender the vehicle no questions asked especially if the Police came knocking.
